In this paper, I argue that an adequate understanding of Husserl’s late ethics of love requires careful consideration of the Neo-Kantian milieu in Southwest Germany. After discussing some general aspects of the contextualization of Husserl’s phenomenology and, in particular, Husserl’s ethics, I move to consider his transition from an action-centered to a life-centered conception of ethics. I show that this transition is largely indebted to Georg Simmel’s critique of Kant’s practical philosophy. In the second part of the paper, I argue (...) that the problem of the value of individuality (Wertindividualit"t) that defines Emil Lask’s early work on Fichte and Heinrich Rickert’s conception of erotics (Erotik) as an autonomous domain of value is the same problem behind Husserl’s re-conceptualization of ethics around the experience of a personal call issuing from a value affecting the subject in an absolute fashion. Does the recent publication of Heidegger’s Black Notebooks require a re-evaluation of his thought? In the present text we will deal with this question and reach the conclusion that a change of theoretical perspective on Heidegger’s work is indeed justified. The franker and less cautious style of the Black Notebooks puts in the foreground stances that were already known, but were previously relegated to the background: it becomes possible thereby to establish that Heidegger’s philosophical views host a significant lot of (...) unwarranted prejudices, which are incorporated in his picture of the ‘history of being’. We argue that in his process of radical questioning Heidegger progressively drops all available rational methods and epistemic criteria, and that this paves the way to the unwitting reception of personal prejudices in his theoretical frame: Heidegger knowingly abandons all the theoretical instruments that could enable him to discriminate between deeply felt prejudices and proper philosophical intuitions. We conclude our analysis by proposing some criticisms that should be acceptable also to scholars sympathetic with Heidegger’s thought. Heidegger’s vindication of an ‘erratic’ way of thinking, where the journey is more qualifying than the result, turns out to be incompatible with the assertiveness of the many unjustified claims disseminated across the Black Notebooks. Moreover, Heidegger wants to show the narrowness of an overwhelmingly dialectical and argumentative attitude, while his late style of thinking unwittingly discredits an alternative philosophical style, that widely appeals to a ‘principle of charity’ in the collaboration between author and reader. Right after our tragedy, my idea of forgiveness was to be free of this thing, – the anger, the pain, the absorption. It was totally personal. It was a survival tactic to leave this experience behind. It had nothing to do with the offender. The second level was realizing how the word forgiveness applies to the relationship between the victim and the offender. How it means accepting and working on that relationship after a murder. The latter is more complicated. Now (...) Both Aristotle and Kant note that the highest form of friendship enables individuals of good virtue to reveal themselves to one another. I argue that Aristotle and Kant emphasize complementary aspects of self-disclosure in friendship: whereas Kant acknowledges the inherent value of self-disclosure in friendship, Aristotle suggests that joint perception in friendship is instrumentally valuable in the acquisition of self-knowledge. I also argue that although Aristotle has a more developed account of friendship, Kant advances a superior account of self-disclosure in (...) friendship in his later remarks on friendship in the Metaphysical Principles of Virtue. This 1995 book takes as its starting point Plato's incorporation of specific genres of poetry and rhetoric into his dialogues. The author argues that Plato's 'dialogues' with traditional genres are part and parcel of his effort to define 'philosophy'. Before Plato, 'philosophy' designated 'intellectual cultivation' in the broadest sense. When Plato appropriated the term for his own intellectual project, he created a new and specialised discipline. In order to define and legitimise 'philosophy', Plato had to match it against genres of (...) discourse that had authority and currency in democratic Athens. By incorporating the text or discourse of another genre, Plato 'defines' his new brand of wisdom in opposition to traditional modes of thinking and speaking. By targeting individual genres of discourse Plato marks the boundaries of 'philosophy' as a discursive and as a social practice. (shrink)

Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. Several attempts have been made previously to provide a biological grounding for cognitive architectures by relating their components to the computations of specific brain circuits. Often, the architecture's action selection system is identified with the basal ganglia. However, this identification overlooks one of the most important features of the basal ganglia—the existence of a direct and an indirect pathway that compete against each other. This characteristic has important consequences in decision-making tasks, which are brought to light by Parkinson's disease as (...) well as genetic differences in dopamine receptors. This paper shows that a standard model of action selection in a cognitive architecture cannot replicate any of these findings, details an alternative solution that reconciles action selection in the architecture with the physiology of the basal ganglia, and extends the domain of application of cognitive architectures. The implication of this solution for other architectures and existing models are discussed. (shrink)

This paper explores an idea of Stoic descent that is largely neglected nowadays, the idea that an argument is valid when the conditional formed by the conjunction of its premises as antecedent and its conclusion as consequent is true. As it will be argued, once some basic features of our naıve understanding of validity are properly spelled out, and a suitable account of conditionals is adopted, the equivalence between valid arguments and true conditionals makes perfect sense. The account of validity (...) outlined here, which displays one coherent way to articulate the Stoic intuition, accords with standard formal treatments of deductive validity and encompasses an independently grounded characterization of inductive validity. This paper examines how behavioral integration of top management teams may contribute to our understanding of how stakeholder initiatives become a part of a firm’s strategy. Multiple case design was used by conducting a series of interviews with the executive teams at three firms in the U.S. telecommunications industry.

The essay discusses Donald Davidson’s concept of anomalous monism in the framework of Husserlian phenomenology. It develops in four stages. Section 1 is devoted to a critical presentation of the argument for anomalous monism. Section 2 succinctly examines those Husserlian notions that best provide the ground for a discussion parallel to Davidson’s. In Sect. 3, the aporetic status of “mental causation” is analyzed by providing a genetic-phenomenological account of efficient causation. Section 4 draws some general conclusions concerning the kind of (...) efficaciousness that must be attributed to consciousness and discusses the sense in which anomalous monism can be defended in a phenomenological framework, but not in a naturalistic one. The article investigates Dostoevsky’s juridical discourse and demonstrates that the apologist of the Russian soul had a genuinely European mind. In his novel The Idiot in particular, in which the death penalty and imprisonment are explored, Dostoevsky unmasks—more radically even than Victor Hugo—the supposedly civilised and lenient forms of modern criminal justice. Dostoevsky’s criticism is ahead of its time; his arguments resemble those subsequently put forward by Foucault. One important mode of philosophical expression from the end of the Hellenistic period and into Late Antiquity was the philosophical commentary. During this time Plato and Aristotle were regarded as philosophical authorities and their works were subject to intense study. This entry offers a concise account of how the revival of interest in the philosophy of Aristotle that took place towards the end of the Hellenistic period eventually developed into a new literary production: the philosophical commentary. It also follows the (...) commentary tradition into Late Antiquity in order to account for the vitality and richness of this tradition. The reader should keep in mind that the study of Aristotle in the form of the commentary did not mean the cessation of genuine philosophical thought. Quite the contrary: authors customarily used the commentary format not only to expound the works of Aristotle, but also as a vehicle for original philosophical theorizing. This paper reports on the findings of a qualitative study to understand how active adherence to the Christian faith influences the way SME owner-managers conceptualise their business practices. The study was based on in-depth interviews with 21 Christian SME owner-managers in Germany and the UK. Using a socio-psychological approach, the data analysis yielded a range of linguistic and conceptual resources that are peculiar to Christian discourse and that have the potential to influence business activity in rather distinctive ways. This paper (...) particularly focuses on those Christian concepts that could be regarded as distinct 'frames' for action. It outlines what effect these concepts had on the respondents and how they were related to business practices. The paper also discusses how this study could inform further research into the influence of other socio-cultural forms of identity on economic actors' conceptualisations of their own practice. John Christman has argued that constitutively relational accounts of autonomy, as defended by some feminist theorists, are problematically perfectionist about the human good. I argue that autonomy is constitutively relational, but not in a way that implies perfectionism: autonomy depends on a dialogical disposition to hold oneself answerable to external, critical perspectives on one's action-guiding commitments. This type of relationality carries no substantive value commitments, yet it does answer to core feminist concerns about autonomy.

Citizen science models of public participation in scientific research represent a growing area of opportunity for health and biomedical research, as well as new impetus for more collaborative forms of engagement in large-scale research. However, this also surfaces a variety of ethical issues that both fall outside of and build upon the standard human subjects concerns in bioethics. This article provides background on citizen science, examples of current projects in the field, and discussion of established and emerging ethical issues for (...) citizen science in health and biomedical research. Logical form has always been a prime concern for philosophers belonging to the analytic tradition. For at least one century, the study of logical form has been widely adopted as a method of investigation, relying on its capacity to reveal the structure of thoughts or the constitution of facts. This book focuses on the very idea of logical form, which is directly relevant to any principled reflection on that method. Its central thesis is that there is no such thing as (...) a correct answer to the question of what is logical form: two significantly different notions of logical form are needed to fulfil two major theoretical roles that pertain respectively to logic and to semantics. This thesis has a negative and a positive side. The negative side is that a deeply rooted presumption about logical form turns out to be overly optimistic: there is no unique notion of logical form that can play both roles. The positive side is that the distinction between two notions of logical form, once properly spelled out, sheds light on some fundamental issues concerning the relation between logic and language. In this paper I explore the issue of how our personal life is given to us in experience as a whole to be actively shaped and determined. I examine in detail Husserl’s analysis of the kind of experience responsible for this achievement, which he terms Überschau and which thus far has never been addressed by scholars of phenomenology. First, I locate Überschau in the context of self-determination and highlight the difference between the unthematic pre-givenness of life in the phenomenon of (...) self-awareness and the actual, i.e. thematic givenness of life in acts of Überschau. Second, I contextualize Husserl’s discovery of Überschau in his analyses of ethical life and the possibility of a universal epoché. I argue that for Husserl the very possibility of ethical life and of phenomenology itself rest on the totalizing apprehension of one’s life rendered possible by Überschau. In the third section I spell out the essential characteristics of Überschau by contrasting this peculiar kind of consciousness with reproductive forms of consciousness such as recollection and expectation, which otherwise might be easily conflated with Überschau. In section four I reply to a possible objection to the very possibility of Überschau based on the consideration of the infinitely open stream of time-consciousness. I argue that the possibility of Überschau is tightly connected with the egological nature of consciousness as understood by Husserl. The ego does not coincide with its own conscious acts and thus enjoys a special vantage point on the totality of its own life. To conclude, I advance a speculative suggestion about the phenomenological origin of Überschau in the structure of self-awareness. This opens up a variety of possible lines of research that would connect Husserl with philosophers such as Augustine or Heidegger who are more immediately associated with the issue of personal life and its unity or lack thereof. Many arguments are affected by context sensitivity, because they include sentences that have different truth conditions in different contexts. Therefore, it is natural to think that a general criterion for evaluating arguments must take context sensitivity into account. One way to give substance to that thought is provided by the definition of validity offered by David Kaplan within his theory of indexicals. However, the route indicated by Kaplan is hindered by a problem whose importance is often underestimated. This paper explores (...) a different route, and outlines a definition of validity that does not run into that problem. Its moral is that Kaplan's definition is not the only plausible definition. This is not to say that the definition outlined is the only plausible definition or that it is correct in some absolute sense. There might be equally important problems with it that the paper does not take into account. But until such problems are found and brought up, the departure from Kaplan's route remains a viable option. (shrink)

Previous research has shown that subliminally presented stimuli accelerate or delay responses afforded by supraliminally presented stimuli. Our experiments extend these findings by showing that unconscious stimuli even affect free choices between responses. Thus, actions that are phenomenally experienced as freely chosen are influenced without the actor becoming aware of the manipulation. However, the unconscious influence is limited to a response bias, as participants chose the primed response only in up to 60% of the trials. LRP data in free choice (...) trials indicate that the prime was not ineffective in trials in which participants chose the non-primed response as then it delayed performance of the incongruently primed response. .This paper discusses Aristotle’s thesis and Boethius’ thesis, the most distinctive theorems of connexive logic. Its aim is to show that, although there is something plausible in Aristotle’s thesis and Boethius’ thesis, the intuitions that may be invoked to motivate them are consistent with any account of indicative conditionals that validates a suitably restricted version of them. In particular, these intuitions are consistent with the view that indicative conditionals are adequately formalized as strict conditionals.

We study a class of formulas generalizing the weak law of the excluded middle and provide a characterization of these formulas in terms of Kripke frames and Brouwer algebras. We use these formulas to separate logics corresponding to factors of the Medvedev lattice.

Non‐invasive brain stimulation is used to modulate brain excitation and inhibition and to improve cognitive functioning. The effectiveness of the enhancement due to transcranial direct current stimulation (tDCS) is still controversial, but the technique seems to have large potential for improvement and more specific applications. In particular, it has recently been used by athletes, both beginners and professionals. This paper analyses the ethical issues related to tDCS enhancement, which depend on its specific features: ease of use, immediate effect, non‐detectability and (...) great variability of effects. If tDCS were to become widespread, there could be some potential side effects, especially the rise of inequality in many selective competitive contexts. I discuss two possible scenarios to counter this effect: that of prohibition and that of compensation, each supported by reasons and arguments that seem plausible and worthy of consideration. In conclusion, I show why I think the scenario of compensation is the preferable one. (shrink)

There are essentially two ways to develop the Peircean idea that future contingents are all false. One is to provide a quantificational semantics for "will," as is usually done. The other is to define a quantificational postsemantics based on a linear semantics for "will." As we will suggest, the second option, although less conventional, is more plausible than the first in some crucial respects. The postsemantic approach overcomes three major troubles that have been raised in connection with Peirceanism: the apparent (...) scopelessness of "will" with respect to negation, the failure of Future Excluded Middle, and the so-called zero credence problem. In the current debate on theodicy, the problem of animal suffering is becoming increasingly relevant, as demonstrated by some recent books devoted to this topic. Such a problem is particularly challenging for a theistic theodicy, as its traditional arguments do not seem able to deal with it. In the first instance, the article aims to provide a brief overview of the main arguments sustained by theists regarding animal suffering, and secondly to provide an evaluation of such arguments which might be (...) useful for further research on this topic. Anecdotal evidence has long lamented the status of social studies in elementary classrooms as observed by preservice teachers. As standardized testing has risen for mathematics and language arts, social studies has been pushed aside. In the aftermath of accountability legislation such as No Child Left Behind, research indicates that social studies is less visible in elementary classrooms due to an instructional focus on tested content areas (e.g. math, language arts, reading). In this study, approximately 90 elementary preservice teachers enrolled in (...) a social studies methods course responded to a survey and indicated the frequency and quality of lessons they observed over the course of a single semester. Findings report that preservice elementary teachers witnessed few, if any, lessons in social studies in the elementary classroom. Implications for teacher education are discussed. (shrink)

It is often contended that certain enhancement technologies are acceptable, because they simply update traditional ways of pursuing the improvement of human capacities. This is not true with reference to moral bioenhancement, because of the radical difference between traditional and biotechnological ways of producing moral progress. These latter risk having serious negative effects on our moral agency, by causing a substantial loss of freedom and capacity of authentic moral behaviour, by affecting our moral identity and by imposing a standard conception (...) of moral personality. Clinical Ethics, Ahead of Print. ObjectiveThe purpose of this study was to assess if a relationship existed between audiologists’ perceptions of moral distress, occupational wellbeing, and patient-practitioner orientation.DesignThe Moral Distress Thermometer, Health and Safety Executive Management Standards Indicator Tool and Patient-Practitioner Orientation Scale was sent out to all audiologists registered with the professional body Audiology Australia.Study sample: A total of 43 audiologists completed the questionnaires.ResultsUsing a multiple linear regression model there was no evidence of a relationship between patient-practitioner orientation and (...) either moral distress or occupational wellbeing. However, an association between higher moral distress and lower occupational wellbeing was demonstrated. The occupational wellbeing subscales of ‘managerial support’, ‘peer support’, ‘relationships’, ‘role’, and ‘change’ were strongly associated with poorer scores on moral distress.ConclusionFor our sample of audiologists, ethical conflict appeared to be linked to reduced job satisfaction. There is a need to consider ways of providing supportive organisational structures in which ethical conflicts can be openly discussed and negotiated in order to improve occupational wellbeing in the profession.
